RES 2016-12 GIVING FINAL APPROVAL OF THE TORVANGER MEADOWS FINAL SUBDIVISIONRESOLUTION NO. 2016-12 A RESOLUTION of the City of Bainbridge Island, Washington, giving final approval of the Torvanger Meadows Final Subdivision. WHEREAS, on February 3, 2015, a preliminary long lot subdivision application was submitted to the Department of Planning and Community Development; and WHEREAS, on September 30, 2015, a public hearing on the subdivision application was held by the Hearing Examiner; and WHEREAS, on October 1, 2015, the Hearing Examiner approved the preliminary subdivision with conditions; and WHEREAS, on March 9, 2016, the applicant, Port Madison Properties LLC, submitted a final subdivision application to the Department of Planning and Community Development; and WHEREAS, during the final plat review process, the City requested corrections to the final plat submittal to bring it into compliance with the preliminary plat approval, and worked with the applicant to explore low impact drainage alternatives in order to preserve significant trees and native vegetation. The applicant has agreed to design individual drainage systems on the individual lots such as raingardens, infiltration and dispersal trenches, with the private stormwater easement remaining in the south east corner of the subdivision as a back-up; and WHEREAS, on April 13, 2016, the applicant provided a final Open Space Management Plan for the Director's approval; and WHEREAS, on May 31, and June 2, 2016 the applicant submitted the final revised plat drawings and civil plans addressing the City's concerns; and WHEREAS, on June 6, 2016, the Department of Planning and Community Development inspected the restoration planting of fifteen 8-10' high evergreen trees within the wetland buffer because, during the initial clearing phase the surveyor erroneously flagged the clearing limits at 60 feet from the wetland buffer instead of 80 feet and the Development Engineer inspecting the clearing limits did not discover the error until after 5 significant trees were removed; and WHEREAS, on June 7, 2016, the City Engineer completed the review of the plans and revisions submitted as part of the final plat and forwarded a recommendation of approval to the Department of Planning and Community Development; and WHEREAS, the applicant has submitted an assurance device adequate to cover the required subdivision infrastructure and improvements, tot lot development, landscape plantings and any other additional restorative plantings necessary for the subdivision; and WHEREAS, the Department of Planning and Community Development has evaluated compliance with the conditions imposed on the preliminary plat and forwarded its recommendation for final subdivision approval to the City Council; and THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. All conditions imposed by the preliminary subdivision approved have been met, as set forth in the final subdivision memorandum from the Department of Planning and Community Development. Section 2. The Port Madison Properties Subdivision (aka Torvanger Meadows) subdivision conforms to the zoning ordinance, the Comprehensive Plan, the subdivision regulations and standards, and all applicable land use ordinances and applicable state law in effect. Section 3. The City Council finds that bonds and assurance devices submitted by the applicant adequately assure completion of all required plat improvements. Section 4. The Mayor is authorized to inscribe the City Council's approval on the face of the final plat, as depicted in attached Exhibit C and incorporated by reference; provided the City Council may direct and authorize another council member to inscribe the City Council's approval on the face of the final plat.
