ORD NO. 2016-18 BOATING UNDER THE INFLUENCEORDINANCE NO. 2016-18
AN ORDINANCE of the City of Bainbridge Island, Washington, adding a new
subsection 12.40.020(E) to the Bainbridge Island Municipal Code (BIMC)
adopting by reference RCW 79A.60.040 operating a vessel in a reckless manner or
under the influence of intoxicating liquor, marijuana, or any drug; establishing
penalties and providing for an effective date.
WHEREAS, the City desires to adopt by reference RCW 79A.60.040 and establish
penalties;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. A new subsection BIMC 12.40.020(E) is hereby added to read as follows:
"E. RCW 79A.60.040 Operating a vessel in a reckless manner or under the
influence of intoxicating liquor, marijuana, or any drug."
Section 2. Penalty. Any person violating the provisions of this Ordinance shall be guilty of a
misdemeanor and upon conviction thereof, shall be punished as set forth in Section 1.24.010
BIMC.
Section 3. This ordinance shall take effect and be in force five (5) days from its passage, approval,
and publication as required by law.
