ORD 2008-18 CPA 15172 - 15196 NMTPORDINANCE NO 2008 18 AN ORDINANCE of the City of Bainbridge Island Washington relating to the Comprehensive Plan adding Policies NM 1 13 NM 3 11 NM 5 9 d NM 5 10 to Chapter 2 of the Non Motorized Transportation Plan of the Transportation Element of the Comprehensive Plan and amending Maps D and E of the Non Motorized Transportation Plan of the Transportation Element of the Comprehensive Plan WHEREAS the City of Bainbridge Island the City adopted a Comprehensive Plan on September 1 1994 which establishes the long range vision for the island and identifies the important characteristics that the community desires to retain promote and foster and WHEREAS the City adopted an update to the Comprehensive Plan on December 8 2004 and I WHEREAS the Comprehensive Plan includes a Transportation Element addressing transportation planning as required by the Growth Management Act as well as the other required and optional elements and WHEREAS the City of Bainbr dge Island adopted a Non Motorized Transportation Plan as a subelement of the Transportation Element of the Comprehensive Plan on December 11 2002 and WHEREAS the Non Motorized Transportation Advisory Committee NMTAC and the Bainbridge Island Metropolitan Park and Recreation District have identified necessary updates and additions to the Non Motorized Transportation Plan and applied for Comprehensive Plan Amendments CPA15196 and CPA15172 respectively and WHEREAS the Planning Commission held two study sessions on this proposed amendment to the Comprehensive Plan on May 22 2008 and June 12 2008 and WHEREAS the Planning Commission held a public hearing on July 10 2008 and continued this hearing until July 24 2008 to consider public input the staff recommendations and the SEP A analysis and WH EREAS the Planning Commission s findings and conclusions regarding its recommendation were forwarded to the City Council for first reading on August 14 2obs and I WHEREAS on August 14 2008 the City Council held first reading on the afnendment and referred the amendment to the Land Use Committee and WHEREAS the Land Use Committee considered the record on August 19 2008 and forwarded the amendment to the Council for second reading and a public hearing WHEREAS on September 10 2008 the City Council held second reading and a public hearing and referred the amendment to the Land Use Committee to consider public comment WHEREAS the Land Use considered the record and public comment on September 30 2008 and forwarded the amendment to the Council recommending third reading and adoption of the amendment WHEREAS on October 22 2008 the City Council held third reading on the amendment considered the record approved the amendment and adopted the findings of the staff report dated August 13 2008 and the Planning Commission findings of July 24 2008 now therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND WAS INGTON DO ORDAIN AS FOLLOWS Section 1 A new Policy 1 13 of the Non motorized Transportation Plat1 sub element of the Transportation Element of the City of Bainbridge Island Comprehensive Plan is added to read as follows f l NM 1 13 At driveways construct walkways that remain at the walking surface plane wherever possible Discussion This can be accomplished by having zero elevation curbs or by setting the walkway back from the curb so driveway aprons are outside the pedestrian zone Where existing rightwoflllway limits design options a request will be made of the property owner to consider granting a necessary easement to allbw the best design Section 2 A new Policy 3 11 of the Non motorized Transportation Plan sub element of the Transportation Element of the City of Bainbridge Island Comprehensive Plan i added to read as follows NM 3 11 Place utility grates outside of the clear pedestrian zone and in the furnishing planting zone or frontage zone wherever possible Discussion This is important to reducing trip slip and fall hazards The zone system is described in the USDOTIFHW A publication Designing Sidewalks and Trails for Access Part 2 Best Practices Design Guide Utility companies will be encouraged to retrofit existing non conforming grates with ones which are slip resistant Section 3 A new Policy 5 9 of the Non motorized Transportation Plan sub element of the Transportation Element of the City of Bainbridge Island Comprehensive Plan is added to read as follows NM 5 9 Develop design and siting guidelines for bicycle parking I 1 l l t Discussion The Bicycle Alliance for Washington and the League of American Bicyclists recommend such requirements Implementation includes designation of minimum design standards and municipal code requirements Section 4 A new Policy 5 1 0 of the Non motorized Transportation Plan subelement of the Transportation Element of the City of Bainbridge Island Comprehensive Plan is added to read as follows NM 5 10 facilities Develop an ADA Transition Plan that includes non motorized Discussion This Plan is required by Title II of the Americans with Disability Act Lack of a Transition Plan negatively impacts people with disabilities as well as others who benefit from improved facilities Section 5 Policy NM 6 2 of the Nonmotorized Transportation Plan is amended to read as follows NM 6 2 Comments shall be solicited from neighborhood residents facility users uud tho larger community at the beginning of the design phase to identify significant elements that define neighborhood character Where feasible design standards for netY non motorized facilities shall incorporate c isting en vironmental features and elements that define neighborhood character such as folloyving topographic features using appropriate nati ve vegetation to separate uses and encouraging the incorporation of appropriato cJcisting trees that retain or enhance the appearance of narrO yl yvinding roadv uys The NMT AC with staff will develop public involvement guidelines for use in proiects with non motorized elements Context Sensitive Solutions ceSS as developed by the Proiect for Public Spaces will be explored as a model for public involvement Discussion Many design elements need to be considered for each particular sito including things such as safety standards or tho presonce of critical areas Cyvhich C viII hUlr c Un impaCt on the ability to rotain existing enlr ironmental or neighborhood character featurcs CSS provides efficient processes maximizing creativity and collaboration to determine and implement optimum design for a sp ecific location CSS incorporates but is not limited to considerations such as following topographic featuresusing native vegetationtt incorporating existing trees using natural drainage and maintaining the appearance of narrow winding roadways The community also desires safe and efficient transportation by a variety ofmodes including walking and bicycling Section 6a A new Policy 6 6 of the Non motorized Transportation Plan sub element of the Transportation Element of the City of Bainbridge Island Comprehensive Plan is added to read as follows NM 6 6 The City will encourage use of Low Impact Development natural drainage in streetscape where appropriate consistent with current ordinance nd municipal code Low Impact Development provides substantial environmerital benefits including promoting rainwater reinfiltration and aquifer recharge reducing stormwater runoff and its associated pollutants and promoting the protection and enhancement of native plant communities Design standards and guidelines will be developed for streetscape applications Discussion Streetscape design for surface water management is integral to road and walkway design Natural drainage iri addition to environmental considerations has a significant effect on aesthetics and safety Current research indicates that vegetation along the roadway can have a traffic calming effect and thus affects safety for non motorized users I Section 7 Maps D and E of the Non motorized Transportation Plan sub element of the Transportation Element of the City of Bainbridge Island Comprehensive Plan are amended as depicted in Exhibit A Section 8 If any section subsection paragraph sentence clause or phrase of this ordinance is declared invalid or unconstitutional for any reason such decision shall not affect the validity 9f the remaining portions of this ordinance Section 96 This ordinance shall take effect and be in force five 5 days after its passage approval and publication as provided by law PASSED by
