ORD 2008-21 CPA 15197 BLAKELY PARKORDINANCE NO. 2008-21
AN ORDINANCE of the City of Bainbridge Island,
Washington, amending the Water Resources Element of the
Comprehensive Plan to include Blakely Harbor Park in the area
shown on Figure 213, City Contracted Sewer Service Areas.
WHEREAS, the City of Bainbridge Island (the "City") adopted a Comprehensive Plan on
September 1, 1994, which establishes the long-range vision for the island and identifies the
important characteristics that the community desires to retain, promote and foster; and
WHEREAS, the City adopted an updated Comprehensive Plan on December 8, 2004; and
WHEREAS, the City's Comprehensive Plan, required by the Growth Management Act,
includes a Water Resources Element, which addresses the management of water resources on
Bainbridge Island; and
WHEREAS, the Bainbridge Island Metropolitan Park and Recreation District
("BIMPRD") purchased the property for Blakely Harbor Park in 2000, and
WHEREAS, BIMPRD desires to construct a restroom in Blakely Harbor Park; and
WHEREAS, BIMPRD has determined that connecting the proposed restroom to the
sewer system of Kitsap County Sewer District 7 (the "Sewer District") is the most desirable
solution; and
WHEREAS, the City has contracted with the Sewer District, and the Sewer District has
the capacity to allow the hook up of the restroom to the sewer system; and
WHEREAS, on February 29, 2008, the City's Public Works Director applied to add the
Blakely Harbor Park Property to the map outlining the City's contracted sewer connections; and
WHEREAS, the Planning Commission held two study sessions on this proposed
amendment to the Comprehensive Plan on May 22, 2008 and June 26, 2008; and
WHEREAS, the Planning Commission held a public hearing on July 10, 2008 and
continued this hearing until July 24, 2008 to consider public input, the staff recommendations
and the SEPA analysis; and
WHEREAS, the Planning Commission's findings and conclusions regarding its
recommendation were forwarded to the City Council for first reading on August 14, 2008; and
WHEREAS, on August 14, 2008 the City Council held first reading on the amendment
and referred the amendment to the Public Works and Transportation Committee; and
WHEREAS, the Public Works and Transportation Committee considered the record on
August 18, 2008 and forwarded the amendment to the Council for second reading and a public
hearing; and
WHEREAS, on September 10, 2008, the City Council held second reading and a public
hearing and referred the amendment to the Public Works and Transportation Committee to
consider public comment; and
WHEREAS, the Public Works and Transportation Committee considered the record and
public comment on September 15, 2008 and forwarded the amendment to the Council
recommending third reading and adoption of the amendment; and
WHEREAS, on October 22, 2008, the City Council held third reading on the amendment
to extend sewer service to Blakely Harbor Park, considered the record, approved the amendment
and adopted the findings of the staff report, dated August 1, 2008; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. Blakely Harbor Park (Tax Parcel Number 022402-3-032-2000) is hereby added to
Figure 213, City Contracted Sewer Service Areas of Water Resource Element of the City of
Bainbridge Island Comprehensive Plan as shown on Exhibit A attached hereto and made a part
hereof by this reference.
Section 2. Severability. If any one or more section, subsections, or sentences of this
ordinance are held to be unconstitutional or invalid, such decision shall not affect the validity of
the remaining portion of this ordinance and the same shall remain in full force and effect.

Section 3. Effective Date. This ordinance shall take effect on and be in force five (5) days from
and after its passage, approval, and publication as required by law.
