The parties in this matter have advised that, pursuant to their settlement agreement, the
appellant requests that this appeal be dismissed with prejudice. This request is equivalent
to withdrawing the appeal.
The Hearing Examiner Rules, Rule 5.3 in Chapter III, Section 5, provide that: "An
appellant's request to withdraw the appeal shall be granted as a matter of right and the
appeal dismissed. "
This appeal should be, and hereby is, DISMISSED and the hearing, scheduled for June 30,
2005, CANCELLED.
