The parties in the abovc captioned matter hereby jointly stipulate to dismissal of
the Appeal of Administrative Decision Mcd in this matter by Appellant on July 2, 2008
(the "Appeal "). The City has issued a decision that rescinds and supersedes the City's
previous decision dated June 23, 2008, which is the subject of the Appeal, and Appellant
has agreed to withdraw the Appeal. Accordingly, the parties respectfully request that the
Hearing Examiner strike the hearing scheduled for September 17, 2008, and issue an order
