I. RECITALS
1.0 Appellants and Respondent have been discussing the application denial dated
November 2, 2016 which is the subject of this appeal.
1.1 Appellants have agreed to submit additional information to Respondent to
support their application, SSDE PLN50438, and Respondent has agreed to consider that
additional information in good faith.
1.2 Appellants and Respondent believe that the time
and resources
of the
parties to
this Stipulation are best placed into the permitting process (and
not litigation)
at this
time.

II. STIPULATION
2.0 IT IS HEREBY STIPULATED that the City of Bainbridge Island's
administrative decision dated November 2, 2016 is without prejudice and that Appellants are
free to submit additional information in support of a shoreline substantial development
exemption (SSDE) for Appellants' property.
2.1 IT IS FURTHER STIPULATED and agreed by counsel for Appellants and
Respondent that Appellants will voluntarily dismiss their appeal without prejudice and
without attorney fees and costs to either party.
2.2 IT IS FURTHER STIPULATED that the City will, in a timely manner, review
any additional materials submitted by Appellants and render a final decision on the updated
SSDE application. Appellants shall retain the right to appeal the City's decision on the
updated application.
