1.Mike Imeson, representing Boulder Glen LLC, appealed a decision of the City's Planning
Director issued November 2, 2016, denying a shorelines substantial development exemption
application for construction of a single family residence at 6967 NE Bergman Road. A prehearing
conference was held by the Hearing Examiner on March 15, 2017, at which time the appellant was
represented by attorney Dennis Reynolds and the City by attorney James Haney.
2.Questions exist as to whether this matter is ready to proceed to hearing in its present form. Mr.
Imeson's November 2, 2016, appeal notice only identified general areas of concern, not specific appeal
issues. And the bases stated for the November 2, 2016, exemption denial frequently cited the
appellant's failure to submit all the technical documentation requested by City staff, a deficiency that to
some extent may be curable without recourse to a hearing. In addition, due to this Examiner's
unavailability during the time frame designated for the appeal, a process for scheduling the hearing
before a Hearing Examiner pro tem needed to be pursued after close of the conference.
3.The following deadlines apply to the procedures described below:
•March 20, 2017. Deadline for the appellant to submit a more definite statement setting forth
the issues being raised on appeal.
•March 31, 2017.Deadline for the appellant to meet with City staff to explore resolution of
issues and curing submittal deficiencies.
•April 17, 2017. Deadline for the parties to exchange with one another witness and exhibit lists,
plus provide copies of any site-specific technical studies newly completed or revised.
•May 4, 2017. Deadline for submitting pre-hearing legal briefs and an updated staff report (if
applicable).
4.The public hearing on the appeal is scheduled to open at the following time and place:
