JOINT REQUEST FOR STAY OF APPEAL
PROCEEDING
COME NOW the Appellants, Eldon and Beth Van Liere, appearing pro se, and the
Respondent, the City of Bainbridge Island, appearing by and through the undersigned attorneys of
record, and jointly request that the Hearing Examiner stay the appeal proceedings in this matter in
order to allow the parties to complete settlement negotiations. The parties have had productive
settlement discussions and believe that an agreement can be reached that will completely resolve the
dispute between then and avoid the necessity of an appeal hearing. The negotiations and a
settlement agreement will not be completed in time for the current hearing scheduled for
Wednesday, April 12, 2017 and so the parties jointly request that the April 12 hearing be stricken
and that the appeal proceedings be stayed pending completion of settlement negotiations. In the
event that the parties are unable to finalize settlement negotiations in a timely manner either party
may request that the stay be lifted and that the matter be reset for hearing.
