NOTICE OF ADMINISTRATIVE DECISION AND SEPA MITIGATED
DETERMINATION OF NONSIGNIFICANCE (MDNS)

Description of Proposal: 110 linear feet of bulkhead; a 174 foot dock with boat hoist; a 196 square foot
gatehouse/boathouse; and a 50 linear foot retaining wall
Location of Proposal: 579 Stetson Place (Tax Assessor No. 342502 -1- 085 -2001)
Permit Decision: Approval of the boathouse /gatehouse, retaining wall and dock subject
to conditions set forth below, and denial of the bulkhead. The staff
report, containing the statement of facts upon which the decision, including
conditions, is based and the conclusions of law derived from those facts, is
available to the public upon request. The decision becomes effective after 14 days
from the date of issuance, or after April 5, 2013.
Following the appeal period, the Department of Ecology has a 21 day appeal
period. Development pursuant to this shoreline permit shall not begin and is not
authorized until 21 days from the date of filing with the Department of Ecology or
until all review proceedings initiated within 21 days from the date of such filing
have been terminated, except as provided in Chapter 90.58 RCW or its successor.
SEPA Decision: The City of Bainbridge Island (lead agency) has determined that the proposal does
not have a probable significant impact on the environment if measures to mitigate
the proposal are used. An environmental impact statement (EIS) is not required
under RCW 43.21C.030 (2) c. This determination was made and mitigation
measures were applied after review of a completed environmental checklist and
other information on file with the lead agency. This information is available to the
public upon request.
This MDNS is issued under WAC 197 -11 -350. The lead agency will not act on
this proposal for 14 days. Comments must be submitted by no later than 4:00
p.m. on April 5, 2013.
APPEAL: This administrative decision and/or SEPA determination may be appealed by filing a written
appeal and paying a $530.00 filing fee to the City Clerk at 280 Madison Avenue North,
Bainbridge Island, Washington 98110, in accordance with the procedures set forth in the
Bainbridge Island Municipal Code, Section 2.16.130 and /or 16.04.170. An appeal must be
filed no later than 4:00 p.m. on April 5, 2013. You should be prepared to make specific
factual objections.

The State Environmental Policy Act (SEPA), chapter 43.21 RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An environmental impact
statement (EIS) must be prepared for all proposals with possible significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.

Consulting in May 2012.

A JARPA package will be submitted to WA Dept. of Fish &
Wildlife, WA Dept. of Ecology, and U.S. Army Corps of
Engineers. A Shoreline Substantial Development permit
application to the City of Bainbridge Island is included with
this package. A Shorelines Exemption for the proposed
bulkhead will be submitted to the City. Consultation with the
Suquamish tribe will be accomplished through the Army
Corps' review process.

for your proposal, if known.
Hydraulic Project Approval (WDFW), Section 10 permit
(USACE), Shoreline Substantial Development Permit,
Shoreline Exemption and Building permit (CORI), Section
401 (DOE) possible.
11. Give a brief, complete description of your proposal, including
the proposed uses and the size of the project. There are several
questions later in this checklist that ask you to describe certain
aspects of your proposal. You do not need to repeat those

Installation of a bulkhead, recreational pier, boarding float,
and gatehouse for private use on a residential lot. The pier
will feature a hoist to lift the boarding float gangway during
bad weather and boat hoist capable of lifting a 28 -32 foot
vessel for storage. A description of each element follows:
• A protective concrete bulkhead will tie into the existing ,(�C�t
bulkhead located on the property to the north and will be
installed following the approximate shape of the -tU%1t
shoreline. The bulkhead footprint, including area of (bb yv 1 cCG'�hrv�
excavation, will be located above OHW. Approximately
100 CY of material will be excavated. The wall will bed _
approximately 110 LF. The wall will be set on approx. 34
CY of base course material with approx.20 CY of new fill

material placed behind the wall to level it out to meet the
existing backyard. Approx. 7 CY of 4" minus rock will be
placed in front of the waterward face of the bulkhead to
provide scour protection. There is no existing bulkhead at
the south end to tie into, so the end of the bulkhead will
be armored by a small scour protection area
(approximately 5'x5') using approximately 2 CY of
quarry spalls. This, too, will be located entirely above
OHW.
• The gatehouse foundation will also be located entirely
above OHW. The foundation is a 141x14' concrete slab on
base course (12 CY of excavation and equal amount of
fill). The gatehouse will serve to secure the dock entry
point.
• The pier access walkway will connect to the gatehouse.
The concrete gatehouse foundation will serve to support
the landward end of the walkway. It will extend over the
bulkhead and will be 110 feet long and 6 feet wide. The
deck elevation is approx. +17.5 feet (MLLW). The
walkway will be of metal construction and will be grated
to allow for light penetration. Approximately midway out
to the pier it will be supported by two (2) 12" dia. steel
piles.
• The boat hoist pier is approximately 280 SF constructed
of wood deck material with steel pile caps. It is supported
by seven (7) 12 -inch dia. steel piles. Top of deck elevation
is approximately +17.5 feet (MLLW). Two of these piles
and two (2) additional piles (also 12 -inch dia. steel)
outside of the deck area will support a boat hoist on the
south side. These hoist frames are each 18'x2' wide. This
will be used for storage of the owner's recreational vessel
during lower tides or storm events. One of the pier piles
on the north side and one additional pile (12 -inch dia.
steel) will support a second independent hoist. This hoist
frame is 2'x8' and mostly overlaps the grated gangway.
This will be used to lift the gangway serving the boarding
float (described below) out of harm's way during storm
events and for launching other small craft such as jet
skis. The bottoms of the hoist frames are located quite
high above the water at approximately +25.5 feet elev.
(MLLW), therefore not significantly contributing to
overwater shading.

• A boarding float (10'00') will be accessed via gangway
from the north side of the pier. The gangway will be 50
feet long, 4 feet wide and made of grated metal to allow
for light penetration. The float will be of wood
construction with poly tub floatation below.
Approximately 50% of the float deck will be grated. The
gangway and float will be anchored by two (2) 12 -inch
dia. steel piles. Brackets will be installed on these piles to
support the float and prevent it from grounding out
during low water. Two (2) additional "stub" piles will be
installed to support the south side of the float during low
water. These piles will extend approximately 1.0 to 1.5
feet above existing mudline.
SUMMARY
Total new overwater area below OHW = 11416 SF
Approximately 910 SF (64 %) will be grated.
Total new 12 -inch diameter steel piles = 17

The bulkhead will be made of approximately 28 CY of
concrete. Approx. 34 CY of bedding course will be placed
beneath the concrete bulkhead and 7 CY of 4 -inch minus
will be placed at the base of the waterward face of the
bulkhead to provide scour protection. A small revetment
apron at the south end of the bulkhead will tie the
bulkhead into the existing grade and provide scour
protection to the end of the bulkhead. This revetment
will use approx. 2CY of quarry spalls

Resident bald eagles are present in the vicinity of the

Marbled Murrelet (Brachyramphus marmoratus
marmoratus)- Federally Threatened
The occurrence of marbled murrelets in Eagle Harbor is
rare and nesting sites have not been seen in the vicinity,
They are not expected to nest in the vicinity clue to the
lack of old growth forests. The nearest critical habitat is
on the Olympic Peninsula approximately 20 miles to the
west. They are not likely to be affected.
Stellar Sea Limn (Eumetoplas jubatus) — Federally
Threatened
It is unlikely that Stellar Sea Lion are present in the
vicinity of the proposed anchorage and moorage area and
there have been no reported observations.
Killer whale (Orcinus orca) — Federally Endangered
It is unlikely that Killer whales are present in Eagle
Harbor, though they would have access from Puget
Sound. This project is not likely to affect them.
Chinook Salmon (Oneorhynehus tshawyischa) —Federally
Threatened
No chinook spawning streams are found in the near
vicinity of the proposed project area and there are no
studies looking at occurrence or abundance in Eagle
Harbor. However, migrating juvenile chinook will likely
use Eagle Harbor for feeding, resting, and refugia.
Chinook are not likely to be affected.
Bull Trout (Salvelinus confluentus) — Federally Threatened
Bull trout may occur in the proposed project area,
however, there are no records or studies that indicate
their presence and /or abundance in Eagle Harbor.
Given the nature and location of the proposed action
there should be no direct or indirect effects upon bull
trout.

The site is within the Pacific Flyway. During higher tides,
it may also be a travelway for migrating salmonids. A

A planting area of native plants will be planted on the
upland side of the bulkhead between the north property
line and the gatehouse to provide mitigation for
footprints of the piles. Installation work will occur only
during agency allowed work windows. Contractor will
employ BMPs applicable to the nature of the work and
site.

a. What kinds of energy (electric, natural gas, oil, wood stove,
solar) will be used to meet the completed project's energy
needs? Describe whether it will be used for heating,
manufacturing, etc.
The exact type of hoist has yet to be identified. Certain
models may require electrical service.

Noise typical of recreational watercraft is common in
Engle Harbor. No additional effects are anticipated.
2) What types and levels of noise would be created by or
associated with the project on a short -term or long -term
basis (for example: traffic, construction, operation,
other)? Indicate what hours noise would come from this
site.
Some additional noise during construction is
anticipated. This will include pile driving using a
vibratory hammer. Impact proofing will be required
as well. Long term noise impacts are not anticipated.
3) Proposed measures to reduce or control noise impacts, if
any:
Construction will adhere to City noise ordinance
hours. Equipment engine muffler systems will be
employed as required by WA state law. Pending
approval by other agencies to ground a work barge,
pile driving will be performed to the extent possible in
the (try to avoid noise impacts to the aquatic
environment. If grounding is not permitted driving
may occur in the water. Sound attenuation measures
will be employed and may include bubble curtain.
Specific sound attenuation measures will be identified
with WDFW and USACE during their permit
reviews.
8. Land and Shoreline Use
a. What is the current use of the site and adjacent properties?
The project site is a residential property, as are the
surrounding parcels to the north and south with single
family homes. There are several residences in the vicinity
that have private dock facilities (see attached exhibit).
The harbor is actively used for recreational and live -
aboard vessels. There are several marinas in the vicinity
