City of Bainbridge Island, Kitsap County, Washington, (Complete legal description on Exhibit A) Assessor's Property Tax Parcel/Account Number(s): 282502-3-008-2009, 282502-3-068-2006, 282502-3-069-2005 Page 1 of 5 RESOLUTION NO. 2018-25 A RESOLUTION of the City Council of the City of Bainbridge Island, Washington, recognizing the vacation by operation of law pursuant to RCW 36.87.090 of a portion of County Road No. 229 located in the East half of the Southwest quarter of Section 28, Township 25 North, Range 2 East, W.M., City of Bainbridge Island, Kitsap County, Washington. WHEREAS, County Road No. 229 was established on August 8, 1911; and WHEREAS, some portions of County Road No. 229 were built in a different location than the originally described alignment and other portions were never opened or used by the public; and WHEREAS, under RCW 36.87.090, any county road, or part thereof, which remains unopen for public use for a period of five years after the order is made or authority granted for opening it is automatically vacated by operation of law; and WHEREAS, that 30 -foot wide portion of County Road No. 229 located in the Southwest quarter of Section 28, Township 25 North, Range 2 East, W.M., City of Bainbridge Island, Kitsap County, Washington was designated as a County Road in 1911 in an area that was subsequently annexed into the City of Bainbridge Island in 1991; and WHEREAS, the City desires to recognize and acknowledge that the 30 -foot wide portion of County Road No. 229 lying east of Island Center Road NE and west of Kojima Avenue has been vacated by operation of law. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. The City of Bainbridge Island hereby recognizes and acknowledges that, pursuant to RCW 36.87.090, the 30 -foot wide portion of County Road No. 229 lying east of Island Center Road NE and west of Kojima Avenue, as legally described on Exhibit A and depicted on Exhibit B, has been vacated by operation of law.
