RES NO. 2018-36 AMENDING FEE SCHEDULE LEGISLATIVE REVIEW OF DEVELOPMENT REGULATIONSRESOLUTION NO. 2018-36
A RESOLUTION of the City of Bainbridge Island, Washington,
amending the City's Fee Schedule to add a fee for "Legislative
Review of Development Regulations" to apply when a person or
entity requests such a change to the Bainbridge Island Municipal
Code, and to otherwise clarify the Fee Schedule related to rezones.
WHEREAS, Bainbridge Island Municipal Code (BIMC) Section 2.16.180, "Legislative
review of regulations and area -wide rezones," states, in part, that "Any person, entity, or the city
may propose an amendment to the BIMC"; and
WHEREAS, the City is clarifying and formalizing the process for requests for legislative
review of development regulations related to the BIMC by creating an application for such non -
City amendment requests; and
WHEREAS, regarding BIMC 2.16.180's title, which, as stated above, refers to
"Legislative review of regulations and area -wide rezones, " the City's current Fee Schedule
includes a fee for "Rezone" in the amount of $3,053, but does not explicitly include a fee for
"Legislative review of regulations," and, as a result, the fee for that activity needs to be clarified
and established in the Fee Schedule; and
WHEREAS, City staff have estimated that the amount of City staff time to process
applications related to legislative review of development regulations is similar to City staff time
related to processing rezone requests and that, therefore, the fee for these activities should be the
same (i.e., $3,053); and
WHEREAS, the current Fee Schedule also includes, related to the "Rezone" fee, an
outdated reference to `BIMC 18.114.030b," and that reference needs to be updated to instead
reference BIMC 2.16.140, which relates to site-specific rezones, and to BIMC 2.16.180, which,
as described above, relates to "Legislative review of regulations and area -wide rezones."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DO RESOLVE AS FOLLOWS:
Section 1. Section 9, Building and Planning Fees, of the City's Fee Schedule is hereby
amended as follows, including to establish and include the following new fee:

Section 2. Section 9, Building and Planning Fees, of the City's Fee Schedule is hereby
amended as follows to correct an outdated reference:

Section 3. The City Clerk is hereby authorized to alphabetize Section 9 of the City's Fee
Schedule to include this new fee.
Section 4. This resolution will take effect immediately upon passage.
