RES NO. 2019-11 RECOGNIZING EMERGENCY AT MANITOU PARK BLVD & APPROVING EMERGENCY WORKRESOLUTION NO. 2019-11 A RESOLUTION of the City of Bainbridge Island, Washington, declaring an emergency at the end of Manitou Park Boulevard; affirming the waiver of competitive bidding requirements to immediately respond to the emergency; and reaffirming the authority of the City Manager to respond to the emergency. WHEREAS, recent winter storms (high winds in conjunction with high tides) have accelerated shoreline erosion at the end of Manitou Park Boulevard; and WHEREAS, the erosion is very close to the existing public road and has exposed a utility vault; and WHEREAS, the adjacent private road, Rolling Bay Walk, is also in immediate danger of being undermined and thereby potentially cutting off access to private homes; and WHEREAS, the City has obtained an emergency Hydraulic Project Approval (HPA) permit from the Washington Department of Fish and Wildlife to complete repairs to Manitou Park Boulevard; and WHEREAS, under BIMC 2.44.050, the City Council has designated the City Manager as the executive head of the City for purposes of emergency management; and WHEREAS, under BIMC 2.44.080, the City Manager is authorized to proclaim the existence or threatened existence of an emergency; and WHEREAS, under RCW 39.04.280, Chapter 2.44 BIMC, and the City's Procurement Policy, the City Manager is authorized to declare an emergency situation exists, waive competitive bidding; requirements, and award all necessary contracts on behalf of the City to address the emergency situation; and WHEREAS, on January 22, 2019, the City Manager made a written finding of the existence of the emergency at the end of Manitou Park Boulevard, in accordance with RCW 39.04.280; and WHEREAS, at the January 22, 2019 Business Meeting, the City Manager notified the City Council of the existence of the emergency and the City Manager's written finding; and WHEREAS, following the January 22, 2019 Business Meeting, the City Manager declared the existence of the emergency at the end of Manitou Park Boulevard; and WHEREAS, the City then engaged a contractor, Sealevel Bulkhead Builders, to perform work to respond to the emergency. Page 1 of 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. The City Council hereby ratifies and confirms the City Manager's declaration of emergency related to the accelerated shoreline erosion at the end of Manitou Park Boulevard. Section 2. The City Council hereby ratifies and confirms the emergency procurement of the services of Sealevel Bulkhead Builders to perform work to respond to the emergency at the end of Manitou Park Boulevard. Section 3. The City Council hereby reaffirms the authority of the City Manager to execute all agreements and obtain all permissions needed to respond to the emergency. Section 4.
