AN ORDINANCE of the City of Bainbridge Island, Washington, correcting an
inadvertent error in Ordinance No. 2019-14 related to Section I I .B. of the City's
Fee Schedule regarding sewer utility fees, as relates to multi -family winter
averaging for sewer rates.
WHEREAS, in March 2018, the City contracted with Financial Consulting Solutions
Group (FCS Group) to evaluate and provide a recommendation to the City concerning water and
sewer monthly rates; and
WHEREAS, the FCS Group prepared a Water and Sewer Rate Study dated March 7,
2019, which was used by the City Council to make revisions to the City's monthly water and
sewer rates; and
WHEREAS, at the May 28, 2019 City Council Business Meeting, the Council adopted
Ordinance 2019-14 implementing the proposed revisions to water and sewer utility fees; and
WHEREAS, since adoption of Ordinance 2019-14, it has been discovered that the
ordinance inadvertently eliminated the existing rate policy that allowed multi -family residential
accounts to use winter averaging to reduce sewer billings in the summer months; and
WHEREAS, the FCS Group Water and Sewer Rate Study dated March 7, 2019, did not
recommend eliminating this rate policy and the intent was to maintain that policy, and this
ordinance will correct that inadvertent error, which has not yet taken effect; and
WHEREAS, this ordinance is being enacted on an emergency basis so that it will take
effect immediately to correct the error described above that currently exists in Ordinance No.
2019-14 prior to the effective date of Ordinance No. 2019-14, which is July 15, 2019, and this
ordinance, therefore, is deemed by the City Council as a public emergency ordinance necessary
for the protection of public health, public safety, public property, or the public peace, and is
made effective upon adoption.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. The rates in Section 11.13. of the City's Fee Schedule as amended by
Ordinance No. 2019-14 are hereby amended as follows:

Section 2. This ordinance shall govern over any provisions of any previously enacted
ordinances or resolutions of the City of Bainbridge Island which relate to sewer or water system
rates and charges to the extent that any such ordinances or resolutions are inconsistent with or
conflict with this ordinance including, but not exclusive to, Ordinance Nos. 1982-20, 2011-26,
and 2012-21, Resolution No. 2018-12, Ordinance Nos. 2003-42, 2009-39, 2011-25, and 2012-22,
Resolution No. 2017-01, and Ordinance 2019-14.
Section 3. Emergency Clause. Pursuant to RCW 35A.13.190, this ordinance is being
adopted as a public emergency ordinance necessary for the protection of the public health, public
safety, public property, or the public peace to ensure that the inadvertent error as above described
that was adopted as part of Ordinance No. 2019-14 is corrected by this ordinance prior to the
effective date of Ordinance No. 2019-14, which is July 15, 2019. As a public emergency
ordinance, this ordinance shall take effect and be in full force immediately upon its adoption.
Non -exhaustive underlying facts necessary to support this emergency clause are included in the
"Whereas" clauses of this ordinance. This ordinance or a summary thereof consisting of the title
shall be published in the official newspaper of the City.
