ORD NO. 2019-19 PROHIBITING THE STOPPING STANDING OR PARKING OF VEHICLES IN BICYCLE FACILITIESORDINANCE NO. 2019-19
AN ORDINANCE of the City of Bainbridge Island, Washington, relating
to the stopping, standing, and parking of vehicles; amending Chapter
10.08 of the Bainbridge Island Municipal Code (BIMC) to include a new
Section 10.08.195 prohibiting the stopping, standing, or parking of
vehicles in areas marked for bicycling.
WHEREAS, the City is improving streets with new bicycle facilities for the
exclusive or preferential use of bicycles; and
WHEREAS, the stopping, standing, and parking of vehicles other than bicycles
in these new bicycle facilities would impede their effectiveness and create a dangerous
situation for bicycle riders; and
WHEREAS, the Council desires to prevent the stopping, standing, and parking of
vehicles other than bicycles in these new bicycle facilities; and
WHEREAS, Chapter 10.08 BIMC sets out regulations governing the stopping,
standing, and parking of vehicles within the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 10.08 of the Bainbridge Island Municipal Code is hereby
amended to include a new Section 10.08.195, to read as follows:
10.08.195 Stopping, standing, or parking prohibited in specified areas
marked for bicycling.
Except when necessary to avoid conflict with other traffic, or in
compliance with the direction of a police officer or official traffic control
device, no person shall stop, stand, or park a vehicle on any area of the
roadway or shoulder designated for the exclusive or preferential use of
bicycles. Any such designations shall comply with the current edition of
the City of Bainbridge Island Design and Construction Standards. For the
purposes of this section, a bicycle is not considered to be a vehicle.
Section 2. This ordinance shall take effect and be in force five (5) days from its
passage and publication as required by law.
