AN ORDINANCE of thc City of Bainbridge Island,
Washington vacating a portion of Unnamed Alley - Port

WHEREAS, a petition to vacate a portion of an Unnamed Alley in the
Port Madison plat ("Unnamed Alley - Port Madison") was filed with the City;
WHEREAS, Carolyn and Thomas Lcigh, the owners of Tax Lot No.
4167-000-036-0009; m~d Mark Wilson owns Tax Lot No. 4167-000-037-0008;
Marie t;allagher owns Tax Lot Nos. 4167 000-038-0007 and 4167-000-039-
0006; Robert & Christine Beattie owns 'Fax Lot Nos. 4167-000-040-0003 and
4167-000-041-0002; Kylc and Susm~ Lutkius owns Tax Lot No. 4167-000-042-
I)001; Kevin McDonald and LeAnn Ebc owns Tax Lot No. 4167-000-043-0000;
Michael and Becky Benz own Tax Lot No. 4167-000-045-0008, wbich lots are
thc sole propcrties abutting the portion ot' Unnamed Alley - Port Madison
requested to be x acated;
WHEREAS, on April 12, 2000, the City Council adopted Resolution No.
21100-1IL setting a public hearing before the Public Works Committee on the
proposed rigbt-ol~way vacation for May 15, 2000;
WHEREAS, on May 15, 2000, thc Public Works Committee held a
public hearing on the issue ot' whether thc City should vacate the portion of the
[ innamed Alley - Port Madison;
'WHEREAS, the Public Works Committee recommended approval of
this road vacation at thc Juue 5, 2000 Public Works Committee meeting;
WHEREAS, the City Council determined that it is in the best interests of
the public health, safety and welfare to vacate the portion of Unnamed Alley -
Por! Madison; and
WHEREAS, pursuant to BIMC 12.34.130 and 12.34.150, Carolyn and
Thomas Leigh, Mark Wilson, Marie Gallagher, Robert and Christine Beattie,
Kyle and Susan Lutkins, Kevin McDonald and LeAnn Ebe, and Michael and
Becky Benz have paid the City the required compensation for the property to be
vacated and have otherwise complied with the provisions of Chapter 12.34
BIMC; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN as follows:
Section 1. The portion of the right-of--way known Unnamed Alley-Port
Madison, which abuts Tax Lot Nos. 4167-000-036-0009, 4167-000-037-0008,
4167-000-038-0007, 4167-000-039-0006, 4167-000-040-0003, 4167-000-041-
0002, 4167-000-042-0001, 4167-000-043-0000, and 4167-000-045-0008 and is
depicted on Exhibit A, attached and incorporated by reference, is vacated to
Carolyn and Thomas Leigh, Mark Wilson, Marie Gallagher, Robert and
Christine Beattie, Kyle and Susan Lutkins, Kevin McDonald and LeAnn Ebe,
and Michael and Becky Benz.
Section 2. The City Clerk is authorized and directed to record a certified
copy of this ordinance with the Kitsap County Auditor's office.
Section 3. This ordinance shall be effective five (5) days from and after it's
passage, approval and publication as required by law.
