ORD 2001-31-B SALARY COMMISSIONORDINANCE NO. 2001-31-B AN ORDINANCE of the City of Bainbridge Island, Washington, establishing a salary conunission for the City; and adding a new Chapter _., 4 to the Bainbridge Island Municipal Code. x,V EREAS. m Ordinance No. 95 34, the City established the salary for City ~,uncil members at $400.00 per month beginning in 1998, with annual increases based t percentage of the most receutly calculated annual increase in the all urban .msume~ price index for the Seattle Tacoma area; and WItEREAS, m Ordinance No. 99-35, the City amended Ordinance No. 95-34, proxide that thc salary of thc City Council members shall be $600.00 per month !~cginning m 2002, with annual increases beginning in 2003 based on a percentage of most recently calculated annual increase in the all urban consumer price index for Seattle Tacoma area; and WHEREAS, in Ordinance No. 2000-11, the City amended Ordinance No. 9% ,5. to provide that the salary of the City Council members shall be $600.00 per month bcgimfing in 2002; and WlfEREAS, Chapter 73, Laws of 2001, effective July 22, 2001, authorizes the ~its to establish by ordinance an independent salary commission with authority to set ~hc' salar~ of the members of the Council and of other elected city officials, and ~mvides ihat thc commission's action fixing such salaries shall supercede any provision tx a city ordinance related to fixing salaries; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, \VASHINGTON. DO ORDAIN AS FOLLOWS: hc~ction 1. A ncx~ Chapter 2.74 entitled "Salary Cormnission" is added to Bainbridge Island Municipal Code to read as follows: 2.74.010 Created - Membership, appointment, compensation, term. \ There is created a salary commission for the city. The coimnission shall consist of seven members, to be appointed by the Mayor with the approval of the city council. t/ A member of the commission shall serve for a three year term x~lthout compensation, and shall be a resident of the city. The initial members shall be appointed for staggered terms. No member of the commission shall be appointed to lnore than txvo terms D A member of the commission shall not be an officer, official, or clnployee of thc city or an immediate family member of an officer, official, or employee of the city. For purposes of this section, "immediate family member" means the parents, spouse, siblings, children, or dependeot relatives of an officer, official, or employee of the c~ty, whether or not living in the household of the officer, official, or employee. 2.74.020 Vacancies. In the event of a vacancy in office of cnmnfissioner, the Mayor shall appoint, subject to approval of the city council, a person to serve the unexpired portion of the term of the expired position 2.74.030 Removal. A member of the commission shall only be removed from office for cause of incapacity, incompetence, neglect of duty, or malfeasance in office, or for a disqualifying change of residence. 2.74.040 Duties. The commission shall have the duty, at such intervals as determined by the connnission, to review the salaries paid by the city to each elected city official. If after such review the commission determines that the salary paid to any elected city official should be increased or decreased, the commission shall file a written salary schedule with the city clerk indicating the increase or decrease in salary. B. Any increase or decrease in salary established by the commission shall become effective and incorporated into the city budget without further action of the city council or the commission. C Salary increases established by the commission shall be effective as to all city elected officials, regardless of their terms of office. D Salary decreases established by the commission shall become effective as to an incumbent city elected officials at the commencement of their next subsequent terms of office. 2.74.050 Referendum. Any salary increase or decrease established by the commission pursuant to this chapter shall be subject to relcrendum petition by the voters of thc city, in the same manner as a city ordinance, upon filing of a relkrendum petition with the city clerk wiihin thirty days after filing of a salary schedule by the commission. In Iht event of the filing of a valid referendum petition, the salary increase or decrease shall not go into effect until approved by a vote of the people. Referendum measures under this section shall be submitted to the voters of the city at the next following general or municipal election occurring thirty days or more after the petition is filed, and shall otherwise bc governed by the provisions of the State Constitution and the law~ generally applicable to referendum measures. SecI~on 2. This ordinance shall take effect and be in full force five days and after its passage, approval and publication, as required by law. PASSED by the City Council this 8~h day of August 2001.
