ORD 2001-50 CHANGING HOURLY RATESORDINANCE NO. 2001-50
AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON CHANGING THE HOURLY RATES THAT ARE
CHARGED FOR LAND USE PERMITS, APPROVALS, AND
ACTIONS; AMENDING SECTION 1.28.035E OF THE BAINBRIDGE
ISLAND MUNICIPAL CODE.
WHEREAS, the City desires to charge for its services in a manner that is fair and
equitable and that does not exceed the total appropriate costs of providing the services;
and
WHEREAS, charges for land use actions are difficult to impose because the
actions involved differ greatly in the amount of effort required and there are statutory
limits on the amounts of some charges; and
WHEREAS, Ordinances No. 99-47 and 2000-51 establish (1) hourly rates to be
charged for time spent by City staff to analyze, review, and process land use permits,
approvals, and actions, and (2) a procedure for setting the hourly rate charge in the future
that involves determining the full cost of the land use regulatory function for the
preceding year (excluding long range planning and policy formulation costs), less a
taxpayer contribution; and
WHEREAS, the financial report of the City for 2000 shows that the City's cost to
process land use permits, approvals and actions was approximately five times the amount
presently being charged for the City's actions, and the City's Preliminary Budget for
2002 shows that the higher charges imposed by this ordinance cover only 27.2% of the
City's direct costs of processing these permits, approvals, and actions and only 24.0% of
the City's total costs of processing these permits, approvals, and actions; and
WHEREAS, the City intends to conduct a complete review of the hourly rate
charge for land use permits, approvals, and actions in the first half of 2002; and
WHEREAS, the City Council has determined that until the City conducts the
hourly rate charge review in 2002, the taxpayer contribution should be the amount
necessary to set the hourly rate charge at $90 per hour; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Paragraph 1.28.035E of the Bainbridge Island Municipal Code is
amended as follows:
1.28.035 Hourly Rate.
E. Until the City Council conducts its hourly rate charge review in 2002
pursuant to Paragraph C above, the City's hourly rate charge shall be
$90.00 per hour.
Section 2. This Ordinance shall take effect and be in force on and after January 1,
2002, which date is more than five days from its passage, approval and publication as
required by law.
