ORD 2001-53 PURCHASING EXEMPTIONS REQUIREMENTSORDINANCE NO. 2001-53
AN ORDiNANCE of the City of Bainbridge Island, Washington,
relating to purchases of supplies, material, equipment and services,
and exempting such purchases temporarily from the bidding
requirements of section 3.72.030 of the Bainbridge Island
Municipal Code.
WHEREAS, RCW 35A.40.210 and 35.23.352 require code cities of under 20,000
population to pumhase supplies, material, equipment or services with a cost of more than
$7,500.00 upon call for bids; and
WHEREAS, RCW 35A.40.210 and 35.22.620 do not require code cities with a
population of 20,000 or more to purchases supplies, material, equipment or services upon call for
bids; and
WHEREAS, in the last census, the City's population increased to over 20,000; and
WHEREAS, BIMC Chapter 3.72, which was adopted pursuant to RCW 35.23.352 when
the City's population was under 20,000, requires all purchases of supplies, material, equipment
and services with an anticipated price of more than $7,500.00 to be acquired by formal call for
bids; and
WHEREAS, in view of the change in applicable state law, the City is reviewing its
process for acquiring supplies, material, equipment and services; and
WHEREAS, during the period of review, the City desires to exempt from bidding the
acquisition of certain supplies, material, equipment and services with an anticipated price of
more than $7,500.00; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 3.72.030 of the Bainbridge Island Municipal Code shall not apply to
purchases of used equipment, supplies, material or services each costing less than $20,000 (1)
after the effective date of this ordinance or (2) for which payment has not been completed by the
effective date of this ordinance.
Section 2. This ordinance shall be effective five days after its passage, approval
and publication as required by law and shall expire on February 28, 2002.
