ORDINANCE NO. 2001- 43
AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, relating to
thc Comprehensive Plan, amending the Water Resource Element, Goal 2 and Policies SSP 1.1,
2.2 and 2.3 and adding one new policy SSP 2.4.
WHEREAS, the City adopted a Comprehensive Plan on September 1, 1994, establishing
goals and policies for the Water Resource Element; and
WHEREAS, a request was received June 29, 2001 from members of the Bainbridge
Island City Council to amend the Water Resource Element of the Comprehensive Plan; and
WHEREAS, on July 25, 2001, the City Council approved the request for Phase II
comprehensive plan amendment processing; and
WHEREAS, the intent of the amendments to the Water Resource Element of the
Bainbridge Island Comprehensive Plan is to facilitate the provision of sewer service in specific
areas of the south end of the city in response to environmental and health concerns; and
WHEREAS, thc Planning Commission held a public hearing September 27,2001 on thc
plan amendment request.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DO ORDAIN, as follows:
Section I Goal 2 of the Water Resource Element of the Bainbridge Island
('omprchensive Plan i~ amended to read as l%lluws:
Goal 2
Ensure that sewage is collected, treated, and disposed of properly to prevent public health hazards
and pollution of groundwater, and surface water, including waters of the Puget Sound, and to
promote recharge of the ~vater of Puget Sound.
Section 2. Sanitary Sewer On-Site Systems Policy SSP 1.1 of the Water Resource Element
of the Comprehensive Plan is amended to read as follows:
SSP 1.1
Properly designed and maintained on-site wastewater disposal systems that are approved by
the Bremerton-Kitsap County Health District or the State Department of Health are a
permanent solution to sewage disposal in most areas of the Island. However, there may be
areas of the Island determined by the Bremerton-Kitsap County Health District to be
unsuitable for on-site wastewater disposal systems due to site conditions (such as steep
slopes, geological or soil conditions, lot size, or proximity to sensitive bodies of water.
Section 3. Public Sanitary Sewer Policy SSP 2.2 Of the Water Resource Element of the
(;omprehensive Plan is amended to read as follows:
SSP 2.2
In public sewer system service areas, new construction should provide for eventual
connection to public sewer systems.
Section 4. Public Sanitary Sewer Policy SSP 2.3 of the Water Resource Element of the
('omprehensive Plan is amended to read as follows:
SSP 2.3
The City sewer service area for the south end of Bainbridge Island (contracted service areas
of the Kitsap County Sewer District No. 7) is shown on figure 2 B.
Section 5. A new Public Sanitary Sewer Policy, SSP 2.4 A, is added to the Water Resource
Element of the Bainbridge Island Comprehensive Plan to read as follows:

Sewer connections shall not be mandated for uses with existing septic systems that are
tully functioning and maintained, provided that the use does not change.
Section 6. A new Public Sanitary Sewer Policy, SSP 2.4 B, is added to the Water Resource
Element of the Bainbridge Island Comprehensive Plan to read as follows:
SSP 2.4 B
Those properties receiving new public sewer service shall pay a proportional share of the
cost for providing that service.
Section 7. The City Clerk is authorized and directed to file this ordinance for record with
thc Kitsap County Auditor, and to file one copy with the recording number with the Kitsap
(:ounty Assessor and the applicant.

Section 8. This ordinance shall take effect and be in force upon its passage, approval and
publication as required by law.
