AN ORDINANCE of the City of Bainbridge sland, Washington, .
relating to the dates and times for sales and di harge of common
fireworks; amending Sections 5.36.110 and 5. 6.160.
WHEREAS, the current Municipal Code specifies at fireworks may be sold
between July 1 and July 4th and discharged only on July 4 ,which is more restrictive
than State regulations.
WHEREAS, the State of Washington has chang the fireworks regulations
allowing sales and discharge of fireworks from December 27 to December 31 st.
WHEREAS, the City Council's intent is to be con istent with the current City
fireworks regulations and allow sales of fireworks from Dec mber 27th to December 31 st
but restrict discharge to only December 31 It; now. therefore,
THE CITY COUNCIL OF THE CITY OF AlNBRIDGE ISLAND,
WASHINGTON DO ORDAIN, as follows:

A. Common Fireworks may be sold by state licensed d permitted vendors within
the city between the hours of 12:00 noon and 11:0 p.m. July 1 through July 4th
and December 27th through December 31 st.
B. Common fireworks may be discharged within the ci between the hours of 11 :00
a.m. and 11:00 p.m. on July 4th and between the ho of 6:00 p.m. December 31 st
through 1:00 a.m. January 1st of the subsequent year.

It is unlawful for any person to store unsold stock of fireworks except in such
places of storage as the fire marshal shall approve. Unsold oeD of fireworks remaining
after the authorized retail sales period shall be returned on 0 before July lOth of the same
year to an_approved storage facilities of a licensed firework wholesaler, to a magazine or
storage place approved by the fire marshal or to a place approved by the S~ate Fire
Marshal. Unsold stocks of fireworks remaining after the uthorized retail sales period
from 12:00 noon December 27th to 11:00 p.m. December 31st shall be returned on or
before January lOth of the subsequent year shall be retu ed to an approved storage
facility of a licensed fireworks wholesaler, to a magazine r storage place approved by
the fire marshal or to a place approved by the State Fir Marshal. Upon receiving a
written application at least 10 days prior to the date of t e proposed storage, the fire
marshal shall investigate whether the character and 10 ation of the storage would
constitute a hazard to any property or be dangerous to any person. Based upon the

investigation, the fire marshal may grant or deny any applic tion for storage subject the
same to such reasonable conditions, if any, as he/she shall pre cribe.
Sec~on 2. This ordinance shall take effect and be in force lye days from .and after its
passage, approval and publication as required by law.
