ORD 2003-14 FIRE SPRINKLER SYSTEM WATER SERVICE CHARGES ORDINANCE NO. 2003 - 14 AN ORDINANCE of thc City of Bainbridge Island, Washington relating to water service charges for customers with oversized water lines for fire sprinkler systems; and amending Section 13.08.040H of thc Bainbridge Island Municipal Code. ¥ iHEREAS, a structure for establishing water and sewer rates, charges and fees was esta ~lished by Ordinance 80-20, as subsequently amended; and ¥ THEREAS, following a professional study, the City restructured its water and sew~ r rates through Ordinance 97-09 to charge for water based in par~ on the size of the w~ .ter line serving each customer; and ¥ ~HEREAS, in 1999 the City Council found that fire sprinkler systems do not place an added burden on the City's water system because they do not normally consume water and because the fire flow demand placed on the City's water system is already i ~cluded in the calculation of the City's water rates; and V rHEREAS, in Ordinance 99-20, the City Council determined not to charge commerc iai customers who have a single line for both a required fire sprinkler system and dom ~stic purposes based on the size of the combined line if certain conditions are met; and V rHEREAS, the City Council now finds that all customers with a single water line serv cing both a required fire sprinkler system and domestic purposes should be charged ~,n the same basis; now, therefore T[tE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHI] ~GTON, DO ORDAIN AS FOLLOWS: S, 'ction 1. Sectionl3.08.040H of the Bainbridge Island Municipal Code is amended to read as follows: Ce.'r.~e--erc!a! Coustomers who connected to the City's water s3 stem on or before February 28, !99! 2003, and who have a single li~ te serving both a required fire sprinkler system and domestic needs m ~y, at their option and expense, install a double-check back-flow p~ evention device and thereafter pay monthly charges based on the size ol the line necessary to serve only their domestic needs. S,,ction 2. Effective Date. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law.
