ORD 2003-27 VIOLATIONS OF THE CODE/ORDINANCES GENERAL PENALITIES ORDINANCE NO. 2003-27 AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, RELATING TO GENERAL PENALTIES FOR VIOLATIONS OF THE CITY CODE AND ORDINANCES; AMENDING CHAPTER 1.24 OF THE BAINBRIDGE ISLAND MUNICIPAL CODE. WHEREAS, the City Council is authorized to modify the City code in accordance with Washington State laws; and WHEREAS, the current City code contains provisions that were adopted after incorporation in 1947 when the City's population was less than 3,100 persons and the City's area was less than three square miles, provisions that were taken from or based on Kitsap County and City of Winslow codes, and provisions that were adopted after annexing the remainder of the island in 1991; and WHEREAS, the City Council desires to remove conflicts and redundancies from the current code; and WHEREAS, the City Council desires to revise the code to provide consistency with state penalties; and WHEREAS, Resolution 2002-38 sets a goal to revise the code to provide for internal consistency and clarity; and WHEREAS, Chapter 1.24 BIMC, relating to general penalties, is designed to apply to all titles, chapters and sections of the code; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 1.24 of the Bainbridge Island Municipal Code is amended to read as follows: Chapter 1.24 GENERAL PENALTY Sections: 1.24.010 General penalties. 1.24.020 Separate offense for each day violation committed. 1.24.010 General penalties. A. Criminal Penalty. 1. Unless otherwise provided, any person violating any provision or failing to comply with any mandatory requirement of this code or any ordinance of the city shall be guilty of a misdemeanor, and shall be punished as stated in RCW 9.92.030, as amended. Any person violating any provision or failing to comply with any mandatory requirement of this code or an ordinance of the city that is designated a gross misdemeanor shall be punished as stated in RCW 9.92.020, as amended. B. Civil Penalty. 1. Any person violating any of the provisions of this code or any ordinance of the city that is designated a civil offense or civil violation shall have committed a civil infraction. 2. Unless otherwise provided by city resolution, any person committing a civil infraction shall be assessed a monetary penalty of $500.00 for each day the violation occurs. 1.24.0:10 Separate offense for each day violation committed. Each person is guilty of a separate offense for each and every day during any portion of which any violation of this code or any ordinance of the city is committed, continued or permitted by any person, and is punishable accordingly. Section 2. This Ordinance shall take effect and be in force on and five days after its passage, approval and publication as required by law. PASSED by the City Council this 9th day of July, 2003.
