ORD 2003-38 ORDERING LID NO. 20 IMPROVEMENTS (S. ISLAND SEWER) CITY OF BAINBRIDGE ISLAND, WASHINGTON
ORDINANCE NO. 2003-38
AN ORDINANCE of the City of Bainbridge Island,
Washington, ordering the improvement of four neighborhoods and
an elementary school site within the City, all in accordance with
Resolution No. 2003-38 of the City Council; establi.~hlng Local
Improvement Dislrict No. 20, sometimes known as the South Island
Sewer LID, and ordering the carrying out of the proposed
improvements by the construction and connection of sanitary sewer
facilities; providing that payment for the improvement be made in
part by special assessments upon the property in the District,
payable under the mode of annual installments as the City Council
may hereinafter det~m, ine; and providing for the issuance and sale
of local improvement district warrants redeemable in cash, or other
short-t~mi financing and local improvement district bonds, or such
other financing as the Council may select.
WHEREAS, by Resolution No. 2003-38, adopted August 13, 2003, the City Council of the
City of Bainbridge Island, Washington (the "City") declared its intention to order the improvement
of four neighborhoods and an elementary school site w/thin the City by the construction and
connection of sanitary sewer facilities, and fixed October 6, 2003, at 7:00 p.m., local lime, in the
Council Chambers located in City Hall as the time and place for hearing all matters relating to the
proposed improvement and all objections thereto or statements in support thereof, and-for
determining the method of payment for the improvements; and
WHEREAS, the engineering firm of Berry'man & Henigar, the City's consulting
engineers, caused an estimate to be made of the cost and expense of the proposed improvements
and certified that estimate to the City Council, together with all papers and information in its
possession touching the proposed improvements, a description of the bonndaries of the proposed
local improvement district and a statement of what portion of the cost and expense of the
improvements should be borne by the property within the proposed district; and
WHEREAS, that estimate is accompanied by a diagram of the proposed improvements
showing thereon the lots, tracts, parcels of land, and other property which will be specially
benefited by the proposed improvements, and the estimated cost and expense thereof to be borne
by each lot, tract and parcel of land or other property; and
WHEREAS, the noncontiguous improvements designated to serve four neighborhoods
and an elementary school site are intended to be installed or constructed within or to serve those
five separate geographical areas, units or neighborhoods, comprising a single local improvement
district (the "District" or the "LID") to be created pursuant to RCW 35.43.050, sometimes
known collectively as Local Improvement District No. 20, or the South Island Sewer LID, and
individually as:
Emerald Heights Neighborhood
Pleasant Beach North Neighborhood
Point White Neighborhood
Rockaway Beach Neighborhood
Blakely Elementary School
; and
WHEREAS, public health and safety problems have been created and now exist in all
five of the areas, units or neighborhoods of the proposed LID because of the lack of adequate
sanitary sewer facilities to serve them; and
WHEREAS, due notice of the ai~ove hearing was given in the manner provided by law,
and the hearing was held. by the City Council on the date and at the time above prescribed, all
persons appearing at such hearing and wishing to be heard were heard, and all objections to the
proposed improvements, and statements and evidence in support thereof, were duly considered;
and

WHEREAS, the City Council is of the opinion that it is in the best interests of the City
that the sanitary sewer improvements as hereinafter describ.ed (the "Improvements") be carried
out, that a local improvement district be created in connection therewith and that all protests or
objections to formation of such District should be overruled; NOW, THEREFORE,
THE C1TY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN as follows:
Section 1. Council Findings. Being fully informed and advised, and after due
consideration, the City Council finds and declares as follows:
(a) The carrying out of the Improvements and formation of the
LID are in the public interest and should be ordered;
(b) The Improvements also are necessary for the protection of
the public health and safety in each of the five areas, units or
neighborhoods of the LID; and
(c) The assessments within the LID should be determined on
the basis of the benefit of each area, unit or neighborhood of the LID
and the Improvements as to the properties specially benefited in that
area, unit or neighborhood.
Section 2. Creation of the LID. The City Council orders the creation of the proposed
single noncontiguous LID within or serving territory of the five areas, units or neighborhoods
described in Exhibit A, attached hereto and by this reference make a part hereof, and also orders
the carrying out of the Improvements described in Exhibit B, attached hereto and by this
reference made a part hereof. In conformity with the wishes of most property owners in the
Emerald Heights neighborhood, Page 1 of 2, Exhibit B, has been revised from the form of that
exhibit attached to Resolution No. 2003-38 in order to specify the use of gravity sewers for that
neighborhood, rather than grinder pumps, which the Council finds will improve the reliability
and quality of service. The LID shall be designated Local Improvement District No. 20 of the
city.

All of the foregoing shall be in accordance with the plans and specifications therefor
prepared by the City's consulting engineem, and may be modified by the City Council as long as
such modification does not affect the general purposes of the Improvements.
Section 3. Estimated Cost and Assessments. The total estimated cost and expense of the
Improvements is declared to be $5,400,000, and approximately $151,840 of that cost and
expense shall be paid by the City and the balance thereof shall be borne by and assessed again.qt
the property specially benefited by such Improvements included in the District which embraces
as nearly as practicable all property specially benefited by such Improvements.
Section 4. Assessment Methods. In accordance with the provisions of RCW 35.44.047,
the City may use any method or combination of methods to compute assessments which may be
deemed to more fairly reflect the special benefits to the properties being assessed than the
statutory method of assessing the properties.
Section 5. Charges in Lieu of Assessments. No property, any portion of which is outside
the District, may connect to those Improvements constructed or made a part of such District
unless either that property shall have been subject to the special assessments on the assessment
roll for that District or the owners of that property shall have paid prior to such connection a
charge in lieu of assessment which shall be at least the equivalent of those assessments which
would have been applied to that property had it been included within that District.
Section 6. Financing Authorized. Local improvement district warrants may be issued in
payment of the cost and expense of the Improvements herein ordered to be assessed, such
warrants to be paid out of the Local Improvement Fund, District No. 20, hereinafter created and
referred to as the Local Improvement Fund, and, until the bonds or other obligations referred to
in this section are issued and delivered to the Pumhaser thereof; to bear interest from the date
thereof at a rate to be established hereafter by the City Finance Director, as issuing officer, and to
be redeemed in cash and/or by local improvement district bonds herein authorized to be issued,
such interest-bearing warrants to be hereafter referred to as "revenue warrants." In the
alternative, the City hereafter may provide by ordinance for internal City financing by means of
an interfund loan or the issuance of other short-term obligations pursuant to chapter 39.50 RCW.
If the City shall authorize expenditures to be made for such Improvements (other than for
any cost or expense expected to be borne by the City) prior to the date that any short-term
obligations or local improvement district bonds or other obligations are issued or authorized to
finance the Improvements, from proceeds of interfund loans or other funds that are not, and are
not reasonably expected to be, reserved, allocated on a long4~tm basis or otherwise set aside to
pay the cost of the Improvements herein ordered to be assessed against the property specially
benefited thereby, the City declares its official intent that those expenditures, to the extent not
reimbursed with prepaid special benefit assessments, are to be reimbursed from proceeds of
short-term obligations, other obligations or local improvement district bonds that are expected to
be issued for the improvement in a principal mount not exceeding $5,400,000.
The City is authorized to issue local improvement district bonds for the District which
shall bear interest at a rate and be paYable on or before a date to be hereafter fixed by ordinance.
The bonds shall be issued in exchange for and/or in redemption of any and all revenue warrants
issued hereunder or other short-term obligations hereafter authorized and not redeemed in cash
within twenty days after the expiratio~ of the thirty-day period for the cash payment without
interest of assessments on the assessment roll for the District. The bonds shall be paid and
redeemed by the collection of special assessments to be levied and assessed against the property
within the District, payable in annual installments, with interest at a rate to be hereafter fixed by
ordinance. The exact form, amount, date, interest rate and denominations of such bonds
hereafter shall be fixed by ordinance of the City Council. Such bonds shall be sold in such

manner as the City Council hereafter shall determine. In the alternative, the City by ordinance
may pledge special assessments on the assessment roll of the District for the payment of a loan
agreement entered into under Chapter 39.69 RCW as authorized by RCW 35.51.050.
Section 7. Competitive Bids for Improvements. In all cases where the work necessary to
be done in connection with the making of such Improvements is carried out pursuant to contract
upon competitive bids (and the City shall have and reserves the fight to reject any and all bids),
the call for bids shall include a statement that payment for such work will be made in cash
warrants drawn upon the Local Improvement Fund.
Section 8. Local Improvement Fund Created. The Local Improvement Fund for the
District is created and established in the office of the City Finance Director, to be known as the
Local Improvement Fund, District No. 20. The proceeds from the sale of revenue warrants or
other short-term obligations drawn against the fund which may be issued and sold by the City
and the collections of special assessments, interest and penalties thereon shall be deposited in the
Local Improvement Fund. Any cash warrants issued to the contractor or contractors in payment
for the work to be done by them in connection with the Improvements, and cash warrants in
payment for all other items of expense in connection with the Improvements shall be issued
against the Local Improvement Fund of the Dislrict.
Section 9. Filine and Posting of Preliminary Assessment Roll. Within 15 days of the
passage of this ordinance there shall be filed with the City Finance- Director the title of the
improvement and District number, a copy of the diagram or print showing the boundaries of the
Dislrict and the preliminary assessment roll or abstract of such roll showing thereon the lots,
tracts and parcels of land that will be specially benefited thereby and the estimated cost and
expense of such improvement to be borne by each lot, tract or parcel of land. The City Finance

Director immediately shall post the proposed assessment roll upon his index of local
improvement assessments against the properties affected by the local improvement.
Section 10. Effective Date. This ordinance shall take effect and be in full force from and
atter its passage and five (5) days following its publication as required by law.
