ORD 2003-50 STORM & SURFACE WATER MANAGEMENT UTILITY ORDINANCE NO. 2003-50
AN ORDI~NANCE of the City of Bainbridge Island, Washington, relating
to the City's storm and surface water management utility; amending
Section 13.24.070 o£the Bainbridge Island Municipal Code; and adding a
new Section 13.24.081 to the Bainbridge Island Municipal Code..
WHEREAS, Chapter 35.67 RCW provides that cities are authorized to establish
storm and surface water ("storm sewer") utilities; and
WHEREAS, the City of Bainbridge Island has had a Storm and Surface Water
Management (formerly called "Storm Drain") utility since 1987; and
WHEREAS, the present rates charged by the City's Storm and Surface Water
Management utility are insufficient to cover the costs of that utility; and
WHEREAS, the revenues generated by the rates established in this Ordinance
will not exceed the cost of providing storm sewer services; and
WHEREAS, the City desires to clarify the stoma sewer rates for property
containing residential condominium units; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, DOES
ORDAIN AS FOLLOWS:
Section 1. Section 13.24.070 of the Bainbridge Island Municipal Code is hereby
amended as follows:
13.24.070 Single-family and duplex residential fees.
The monthly service fee for each single-family and duplex residential
dwelling shall be $6.50, provided that the ratio of inapervious to pervious
surface of the lot shall not exceed 50 percent. If the ratio of impervious to
pervious surfaces exceeds 50 percent, the rate established in Section
13.24.080 shall apply.
Section2. A new Section 13.24.081 is added to the Bainbridge Island
Municipal Code as follows:
13.24.081 Condominium unit fees.
A: For property containing residential condominitmas where no more
than one condominium unit is located in any single building, the monthly
service fe~ for each condominium unit shall be the rate charged for single
family dwellings under BIMC 13.24.070.
B. For property conta~nlng residential condominiums where two or
more condominium units are located in a single building, the monthly
service fee for each condominium unit shall be equal to the monthly fee
under this Chapter if the property contained a multiffamily use, divided by
the number of condominium units on the property, which is expressed as
the following formula:
(Monthly fee under Chapter 13.24 if property was multi-family) = Monthly Service
Number of condominium units on the property Fee per Unit
Section 3. This ordinance shall take effect and be in force on and after January 1,
2004, which date is more than five days from and after its passage, approval, and
publication.
