ORD 2003-42 WATER & SEWER SERVICE RATES, CHARGES & FEES ORDINANCE NO. 2003-42
AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, RELATING TO THE CITY'S WATER AND SEWER
SERVICE RATES, CHARGES AND FEES; AMENDING SECTIONS E.5.b,
E.5.c, E.5.d, AND E.5.g OF ORDINANCE NO. 82-20; AND AMENDING
SECTION 2 OF ORDINANCE NO. 97-09 AND SECTION 1 OF
ORDINANCE 2002-50.
WHEREAS, in Section E.5 of Ordinance No. 82-20, the City established a structure
for water and sewer rates, charges and fees, and in particular, in Section E.5.b of Ordinance
No. 82-20 the City established a structure for water service rates; and
WHEREAS, more recently, the City Council amended Section E.5 of Ordinance No.
82-20 in Section 2 of Ordinance No. 97-09 and again in Section 1 of Ordinance 2002-50; and
WHEREAS, in 2002, the City caused a professional study to be performed by
consultants on the issue of the City's water rates, charges and fees, to determine a reasonable
and appropriate structure and amount of the water rates, charges and fees; and
WHEREAS, the City caused to be published in the City's legal newspaper and mailed
to each of the City's water customers a notice of a public hearing on water rates, to be held on
December 2, 2002; and
WHEREAS, the City Council's Finance Committee conducted the hearing described
above on December 2, 2002, at which time members of the public had the opportunity to
comment, and the Finance Committee has considered all written comments received by the
City on the issue of the City's water service rates, charges and fees; and
WHEREAS, the City Council has determined that the City's water rates, charges and
fees should be increased as set forth below, in order for the City to recover its costs of
providing water service in accord with the 2002 professional study mentioned above; and
WHEREAS, the City Council has determined that the City's water rates for the
Rockaway Beach area, together with its sewer charges and fees should be increased 4.3% as
set forth below, in order for the City to recover its costs of providing sewer service, in lieu of
the increase specified in BIMC 13.16.060 (which would require a 4.3% increase if the
November CPI-U equaled the September CPI-U); now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION 1. Section E.5.b of Ordinance No. 82-20, as amended by Section 2 of
Ordinance No. 97-09 and Section 1 of Ordinance No. 2002-50, is amended to read as follows:

b. WATER RATES
Water Rates for the Winslow Water System:
The monthly rate for all categories of users shall be as follows except as
authorized in paragraph 5.for 5.h below:
Users in Category 1 (SFR) shall pay a monthly fixed base rate based on size of
water meter as follows:
Up to 3A" $21.37

Plus a charge for consumption on an incremental basis as follows:
For the first 500 cubic feet $2.16 per 100 cubic feet

For amounts over 3,000 cubic feet 6.72 per 100 cubic feet
Users in Category 2 (Multiple Dwellings) shall pay a monthly fixed base rate
for each residential unit of: $10.66
Plus a charge for consumption on an incremental basis as follows:
For the first 500 cubic feet $2.16 per 100 cubic feet per unit
For the next 700 cubic feet 3.50 per 100 cubic feet per unit
For the next 1,800 cubic feet 4.94 per 100 cubic feet per unit
For amounts over 3,000 cubic feet 6.72 per 100 cubic feet per unit
Users in Category 3 (Commercial / Public) shall pay a monthly fixed base rate
based on size of water meter as follows:.

Users in Category 4 (Other), other then irrigation systems or construction
projects, shall pay a monthly fixed base rate based on size of water meter as
follows

Users in Category 5 (Industrial), shall pay rates as set by individual contract,
which contract shall not provide rates less than any of the categories 1
through 4.
All users of separate Irrigation systems (defined as water systems primarily
designed for the watering of plants and which do not connect directly or
indirectly to the City's sewer system) shall pay a monthly base rate based on
size of water meter as follows:

Plus a charge for consumption of: $7.71 per 100 cubic feet
Water for construction projects shall be made available to contractors at the
option of the city at a location or locations to be specified by the city at a price

of $7.71 per 100 cubic feet of water plus 125% of the direct costs to the city of
connection set up and water delivery plus a billing charge of $22.20 per bill
sent.
Water for single family residential construction at the construction site prior to
the final inspection of the property shall be available through the residential
meter and piping at a fixed charge of $111.00 per 90 days or portion thereof.
Water Rates for the Rockawav Beach Area:
The monthly rate for all categories of users shall be as follows except as
authorized in paragraph 5.for 5.h below:

Sewer Rates for Users of Both Water and Sewer:
Effective January 1, 2004, sewer rates for customers who also contract with the
City for provision of water shall be as follows:
CATEGORY 1 (Single Family) $20.73 per month/unit plus
$3.54 per 100 cu.ft, of water.
CATEGORY 2 (Multi-Family) $18.15 per month/unit plus
$3.54 per 100 cu.ft, of water.
CATEGORY 3 (Commercial / Public) $60.05 per month/unit plus
$3.54 per 100 cu.ft, of water.
CATEGORY 4 (Mixed Use) $60.05 per month/unit plus
$3.54 per 100 cu.ft, of water.
CATEGORY 5 (Industrial) Set by individual contract
SECTION 3. Section E.5.d of Ordinance No. 82-20, as amended by Section 2 of
Ordinance No. 97-09, is amended to read as follows:
Sewer Rates for Users Without Water Service:
The following monthly sewer rates shall apply to billings for users who do not contract
with the City for the provision of water services.
For users in the Winslow area, the following rates apply:
CATEGORY 1 (Single Family) $58.16 per month/unit
without meter
CATEGORY 3 (Commercial / Public) $62.83 per ERU
SENIOR FLAT RATE $29.08 per month
without meter
For users in the Lynwood Center area:
If connected to the sewer line $43.75 per ERU.
If not connected to the sewer line No charge.
SECTION 4. Section E.5.g of Ordinance No. 82-20, as amended by Section 2 of
Ordinance No. 97-09, is amended to read as follows:
f. GEOGRAPHIC AREA COVERED BY WATER RATES
The water rates shown in Paragraph 5.b above shall apply only to those
customers taking service within or connected to the Winslow water system
(defined as that water system which provides City water to the area known as
"historic Winslow") or the Rockaway Beach water system. Customers of other
water systems, if any, shall pay rates sufficient to cover the full cost of

providing the service, using the same rate structure as that shown in paragraph
5.b, and specified by resolution of the City Council as a percentage of the rates
in effect within the Winslow water system.
SECTION 5. This Ordinance shall take effect and be in force for utility bills generated
on and after January 1, 2004, which date is more than five days after its passage, approval and
publication as required by law.
