ORD 2003-44 DEFINITIONS OF TERMS IN ZONING CODE ORDINANCE NO. 2003-44 AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, RELATING TO DEFINITIONS OF TERMS IN THE ZONING CODE; AMENDING SECTIONS 18.06.280, 18.09.040 AND 18.114.030 OF THE BAINBRIDGE ISLAND MUNICIPAL CODE; AND REPEALING SECTIONS 18.06.050, AGENCY, 18.06.150, BUILDING OFFICIAL, 18.06.170, CITY, 18.06.230, COUNCIL, AND 18.88.110, SEVERABILITY, OF THE BAINBRIDGE ISLAND MUNICIPAL CODE. WHEREAS, the City Council is authorized to modify the City code in accordance with Washington State laws; and WHEREAS, the City Council passed Ordinance No. 2003-22, creating consistent definitions for words and phrases that are used in multiple code provisions in a similar context, and Ordinance No. 2003-24, relating to general provisions applicable to all titles of the City code; and WHEREAS, the City Council desires to remove inconsistencies and redundant terms fi.om the current code; and WHEREAS, Resolution 2002-38 sets a goal to revise the City code to make the codes more internally consistent and clear; and WHEREAS, notice was given September 29, 2003, to the Office of Community Development in conformance with RCW 36.70A.106; and WHEREAS, the Planning Commission conducted a public hearing on October 23, 2003; and WHEREAS, the Planning Commission recommended approval on October 23, 2003; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Sections 18.06.050, Agency, 18.06.150, Building official; 18.06.170, City; 18.06.230, Council; and 18.88.110, Severability; of the Bainbridge Island Municipal Code are repealed. Section 2. Subsection 18.09.040 E of the Bainbridge Island Municipal Code is amended to read as follows: Ordinance 2003-44, conforming zoning definitions with Ord. 2003-22 and -24 Page 1 of 2 firstreading: 11/12/03 second reading: 12/10/03 third reading: 1/14/04 E. Where physical or other features existing on the ground are at variance with those shown on the official zoning map, or in other circumstances not covered by subsections A through D of this section, the ag,a~y planning commission shall interpret the zoning district boundaries. Section 3. Section 18.06.280, Director, of the Bainbridge Island Municipal Code is amended to read as follows: "Director" means the director of the planning and community development department. Section4. Subsection 18.114.030B.6. of the Bainbridge Island Municipal Code is amended to read as follows: Any other materials the department or the ag:ney reviewing body determines are required to adequately describe the proposal. Section 5. This Ordinance shall take effect and be in force on and five days after its passage, approval and publication as required by law. PASSED by the City Council this 1~h day of January, 2004.
