ORD 2004-03 COUNTRY CLUB ROAD VACATION ORDINANCE NO. 2004-03 AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DISCLAIMING ANY INTEREST IN A PORTION OF COUNTRY CLUB ROAD THAT WAS INTENDED TO BE VACATED BY THE KITSAP COUNTY BOARD OF COMMISSIONER'S WHEREAS, in 1990, the Kitsap County Public Works Engineering Department caused a portion of Country Club Road to be relocated; and WHEREAS, on the 26th of November, 1990, the Kitsap County Commission entered a Final Order of Vacation for a portion of Country Club Road that was to be abandoned; and WHEREAS, the area of the roadway was annexed to the city; and WHEREAS, an incorrect description of the roadway to bc vacated was entered into the Board's Journal; and WHEREAS, on June 12th, 1995, the Kitsap County Public Works Engineering Office filed the Final Order of Vacation in the office of the Kitsap County Auditor, under Auditor's File Number 9506120056; and WHEREAS, a portion of the right-of-way intended to be vacated lies within Lot D of the "Tract F Short Plat" recorded under Auditor's File Number 901213088; and WHEREAS, the City Council desires to correct the error and clear the title of Lot D; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City of Bainbridge Island disclaims all interest in the following described abandoned right-of-way: That portion of abandoned right-of-way of Northeast Country Club Road situate in Government Lot 7, Section 2, Township 24 North, Range 2 East, Willamette Meridian, City of Bainbridge Island, Kitsap County, Washington, lying Northerly of the right-of-way of the Northeast Country Club Road realignment described in the right-of-way deed reenrded under Kitsap County Auditor's File Number 9012130088 and West of the H:\City Exchange\Ordinances~2004 Ordinances~2004-03_Counlry Club Page 1 of 2 Road Realign_CC_021104~doc East line of Lot D of the Tract F Short Plat recorded under Kitsap County Auditor's File Numbers 200105310389 and 200105310390. Said portion of abandoned Northeast Country Club Road lies between Stations 0+50 and 3+75 as shown on the plan and profile for the Country Club Road Realignment, dated May 18; 1989, revised September 6, 1989 and on file at the Kitsap County Public Works Department. Section 2. This Ordinance shall take effect and be in force five days after its passage, approval and publication as required by law. PASSED by the City Council tiffs 11a', day of February, 2004.
