RES 2001-29 APPROVAL OF FT WARD PARADE GROUNDS SUBDIVISION PRELIM PLANT (SUB06-14-00-1)RESOLUTION NO. 2001-29 A RESOLUTION of the City of Bainbridge Island, Washington, approving the Fort Ward Parade Grounds Subdivision preliminary plat (File No. SUB06-14-00-1). WHEREAS, on June 14, 2000, a preliminary plat application was submitted by Kitsap County Consolidated Housing Authority to the Department of Planning and Community Development; and WHEREAS, the preliminary plat application facilitates reconfiguration of 24 existing residential lots into 22 residential lots with open space on a 4.98 -acre site generally bounded by Parkview Drive and Evergreen Avenue in the Fort Ward area of Bainbridge Island; and WHEREAS, the Department of Planning and Community Development reviewed and forwarded its recommendation for conditional approval to the Hearing Examiner; and WHEREAS, on January 26, 2001 and February 7, 2001, the Hearing Examiner conducted a public hearing on the preliminary plat upon proper notice; and WHEREAS, on April 23, 2001, the Hearing Examiner recommended conditional approval of the preliminary plat and entered her Findings of Fact, Conclusions of Law, and Recommendation; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section . The Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner (File No. SUB06-14-00-1), as set forth in Exhibit "A", which is attached and incorporated by reference, is adopted as the final decision of the Bainbridge Island City Council, except as modified by the following amendment: 1. Condition No. 22: The following note shall be placed on the final plat: Open Space A shall be limited to informal recreation such as bird watching, walking, photograph, picnicking, and kite flying. In addition, upon recommendation of the Fort Ward Neighborhood Association, a portion of the open space may be developed as a children's playground consistent with historical uses of the open space. Organized sporting events, the creation of formal sports fields, and the use of motorized vehicles (except related to maintenance activities) shall be prohibited. Open Space B shall be retained as an area of lawns and gardens. Fort Ward Parade Grounds Subdivision Preliminary Plat Page 1 Section 2. The proposed subdivision is in conformance with the zoning ordinance, the comprehensive plan, the subdivision regulations and standards, and all applicable land use ordinances and applicable state law in effect at the time the fully completed application for preliminary plat approval was submitted by the applicant to the Department of Planning and Community Development. Section 3. The final plat of Fort Ward Parade Grounds Subdivision shall state on its face that it is subject to the conditions of approval set forth in this resolution.
