RES 2001-34 EXCHANGE OF REAL PROPERTY BETWEEN COBI AND BAINBRIDGE PUBLIC LIBRARYRESOLUTION 2001-34 A RESOLUTION of the City of Bainbridge Island, Washington, approving an exchange of real property between the City and Bainbridge Public Library, Inc. WHEREAS, Bainbridge Public Library, Inc., a non-profit corporation ("Library") desires to acquire an approximately 20 -foot by 170 -foot parcel of City land ("City property"), totaling approximately 3,400 square feet, located immediately south of property owned by the Library at the comer of High School Road and Madison Avenue ("Library property"); and WHEREAS, the City property separates the Library property from property also owned by the Library and located to the south of the City property (collectively referred to as "Library Properties"); and WHEREAS, the City desires to acquire from the Library two strips of land approximately four, five and six feet in width along the Madison Avenue side of the Library Properties, totaling approximately 2,289 square feet ("right-of-way property"), in order to provide a uniform half -street right-of-way width of 30 feet; and WHEREAS, the City is willing to transfer ownership of the City property to the Library, as long as the City retains easements for pedestrian access, and underground utilities; and WHEREAS, the Library is willing to dedicate the right-of-way property to the City; and WHEREAS, the City property was not obtained for utility purposes; and WHEREAS, based on the assessed valuations of these and surrounding properties, the City property is valued at $17,561.00 and the right-of-way property is valued at $19,997.00; and WHEREAS, the diminution in value of the City property due to the retained easements is estimated at $3,500, making the true value of the City property $14,061.00, which is less than the value of the right-of-way property; and WHEREAS, the City and Library recognize that the retained easements may need to be relocated to a mutually acceptable location (such as the setback area on the south and east sides of lot 118) with future development of the Library Properties, and WHEREAS, the City Council finds that the exchange of the City property and the right-of-way property is fair, equitable and in the best interests of the public; now, therefore Resolution 2001-34 Page 1 of 2 \\ENG\DATA\TRN\City Resolutions\2001 RESOLUTIONS\2001-34_Exchmge_of Properly_City_Librmy.doc THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON DOES RESOLVE AS FOLLOWS: 1. That in exchange for a right-of-way deed from Bainbridge Public Library, Inc., a non-profit corporation, for the parcel described on Exhibit A to this resolution, (approximately 2,298 square feet of property along Madison Avenue), the City shall transfer by quit claim deed to Bainbridge Public Library, Inc., the City - owned parcel described on Exhibit B to this resolution (approximately 3,400 square feet of land perpendicular to Madison Avenue); provided, that the City shall reserve from the Exhibit B parcel easements for pedestrian access and underground utilities. Upon request of the Library in connection with redevelopment of the Library Properties, the City and the Library shall relocate the easements to a mutually acceptable location on the Library Properties. 2. That the Mayor is authorized and directed to execute the quit claim deed, in a form approved by the City Attorney, and any other documents necessary to complete the exchange of properties, and to accept and record the right-of-way deed in a form approved by the City Attorney.
