RES 2001-38 APPROVAL OF FINAL PLAT AMENDMENT FOR WEAVER CREEK SUBDIVISION (SUBA03-09-01-1)RESOLUTION NO. 2001 -38 �A RESOL .UTION of the City of Bainbridge Island, Washington, approving a final plat amendment for Weaver Creek Subdivision (SUBA03-09-01-1) WHEREAS, B1MC Chapter 18.90 requires that affordable dwellings created pursuant to 711c rcquucmcnts of that chapter remain affordable housing for a period of 30 years from the omnMncement date; and WHEREAS, by Ordinance 99-36, passed on November 23, 1999, the City Council amended Housing Element Policy H 4.7 of the Comprehensive Plan to replace the 30 -year home ownership affordability requirement with an alternative mechanism; and WHEREAS, the City Council passed Resolution 99-39 on December 22, 1999, adopting ntcim administrative regulations for implementing Ordinance 99-36; and WHEREAS, several developers and owners of lots planned for the constriction of 1I1ci dahle housing units or prepared land use applications for submittal to the City based on the idolised interim administrative regulations; and WHEREAS, the City Council passed Ordinance 2000-40 on November 29, 2000, to all( -.v developers and owners who submitted completed land use applications by September .)000 to utilize the alternative mechanism provided by Ordinance 99-36 if they so choose; ,1110 WHERF,AS, utilizing the alternative mechanism requires an alteration of subdivision pul�uant to RCW 58.17. and WHLREAS, in response to Ordinance 2000-40, the owner of Weaver Creek Subdivision ;uhnutted a final plat amendment application to the Department of Planning and Community [k, clopmcnt, and k% FIERFAS, the Department of Planning and Community Development reviewed and ,rnAudcd its recommendation for approval to the City Council; now therefore, I t I E CIDP COONCIL Oh THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, )()ES RESOLVE AS FOLLOWS: lection I Dile affordable housing amendment proposed for Weaver Creek Final Plat ,nllrms to all terms and conditions of -Ordinance 2000-40. -�cction 2 The proposed subdivision amendment is in conformance with the zoning r(livarcc. the comprehensive plan, the subdivision regulations and standards, and all applicable inti ,c ordinances and applicable state laws in effect at the time the fully completed �pphcauion for tinal plat amendment approval was submitted by the applicant to the Department Planning and Community Development. ection=. the Mayor or COnncil Chair is authorized and directed to inscribe and pec utc the Cih- Cotmcil's approval on the face of the amended final plat. )ection 4.
