RES 2001-39 FINAL PLAT AMENDMENT FOR WINSLOW'S COVE SUBDIVISION (SUBA03-09-01-3)RF,SOLUTION NO. 2001 -39 \ RESOL UTION of the City of Bainbridge Island, Washington, approving a final plat amendment for Winslow's Cove Subdivision (SUBA03-09-01-3) WHEREAS, BIMC Chapter 18.90 requires that affordable dwellings created pursuant to hr quirements of that chapter remain affordable housing for a period of 30 years from the nnurnrncement date; and WHEREAS, by Ordinance 99-36, passed on November 23, 1999, the City Council amended Housing Element Policy H 4.7 of the Comprehensive Plan to replace the 30 -year honi-, ownership affordability requirement with an alternative mechanism; and \-VHFREAS. the City Council passed Resolution 99-39 on December 22, 1999, adopting nt�i �m administrative regulations for implementing Ordinance 99-36; and WH P RFAS, several developers and owners of lots planned for the construction of [fliordnhlc housing units or prepared land use applications for submittal to the City based on the ❑depicd interim administrative regulations, and WHEREAS, the City Council passed Ordinance 2000-40 on November 29, 2000, to a11o\� developers and owners who submitted completed land use applications by September -i 1U00 to utilize the alternative mechanism provided by Ordinance 99-36 if they so choose; and WHF;REAS. utilizing the alternative mechanism requires an alteration of subdivision pxir,uant to RCW 55 17, and WFIIEREAS. in response to Ordinance 2000-40, the owner of Winslow's Cove Suhdi� inion submitted a final plat amendment application to the Department of Planning and onununity Development; and WHEREAS, the Department of Planning and Community Development reviewed and wr aided its recommendation for approval to the City Council; now therefore, iiF CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, I � Rl[SOI VFAS FOLLOWS: ,,cction_ 1 The affordable housing amendment proposed for Winslow's Cove Final Plat olit � u» to al terms and conditions of Ordinance 2000-40. ,,)cction 2.
