RES 2001-46 APPROVAL OF WOODLAND VILLAGE SUBDIVISION (FSUB10096)RESOLUTION NO. 2001-46 A RESOLUTION of the City of Bainbridge Island, Washington, approving the Woodland Village Subdivision final plat (Case No. FSUB10096) WHEREAS, the city council approved the preliminary plat under Resolution 2000-6A, on May 2, 2000; and WHEREAS, the application for final plat was submitted July 30, 2001 and all additional materials to review the final plat application were received September 20, 2001; and WHEREAS, the Department of Public Works reviewed and forwarded its recommendations for approval to the Department of Planning and Community Development; and WHEREAS, the Department of Planning and Community Development reviewed all conditions of approval and found the proposed final plat meets all preliminary plat conditions of approval; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The subdivision proposed for final plat approval conforms to all terms and conditions of approval for the preliminary plat. Section 2. Because the city agreed to save trees in Open Space Tracts A and B by moving the required sidewalk to a location internal to the subdivision from the right-of-way, it is understood that Condition of Approval Number 35 will allow sidewalk maintenance activities and tree or vegetation removal for safety reasons within Tracts A and B. Condition of Approval Number 35 shall be understood to read as follows: A minimum of 15 percent of the significant trees located outside of the Open Space Tracts and required buffers shall be retained. There shall be no cutting or clearing in the buffers except as necessary to construct boundary fencing, and except for construction and maintenance of the required sidewalk. Any tree removal shall be approved by the director in accordance with BIMC 18.85.060(C). Section 3. The subdivision proposed for final plat approval conforms to the zoning ordinance, the comprehensive plan, the subdivision regulations and standards, and all applicable land use ordinances and applicable state law in effect at the time the fully completed application for preliminary plat approval was submitted by Landmark Homes to the Department of Planning and Community Development. Section 4. The City Council finds that bonds and assurance devices by their essential term assure completion of all required plat improvements; however, the following items are needed prior to signing and recording the plat: • performance bond or assurance device to provide permanent signs around wetland buffer (Condition of Approval 18). • an approved and signed open space management plan (Condition of Approval 17). • payment of all outstanding billing fees (BIMC 1.28.045D). • payment of half of the school impact fees for 27 lots ($41,715) (BIMC 15.28.090A.1.). Section 5. The Mayor is authorized and directed to inscribe and execute the City Council's approval on the face of the final plat. Section 6. The City Clerk is authorized and directed to file the original of the final plat for record with the Kitsap County Auditor and to file one reproducible copy of the final plat (containing the Kitsap County Auditor's recording number) with the City Clerk, the City Engineer, the Kitsap County Assessor and the applicant.
