A RESOLUTION of the City of Bainbridge Isl , Washington,
relating to the undergrounding of overhead utiliq service wires
on Ericksen Avenue by private property owners in accordance
with Chapter 15.36 of the Bainbridge Island Muni ipal Code.
Wby Resolution No. 2002-13, the City Council determined that the
" system" overheard power, communication and other utility wires on Ericksen Avenue between
Winslow Way and Knechtel Way shall be placed underground a part of the Ericksen Avenue
pedestrian and bicycle irovements project; and
WHIrE the City Council passed Ordinance No. 002-35 establishing Chapter
15.36 of the Bainbridge Island Municipal Code, providing a procedure to have owners of
property abutting projects where the system overhead utilitiesa placed underground in a
street to place underground the "service" utility wires on such pr � perty, and
WHE_�Fw�, the City Council desires to require the owners of property abutting
Ericksen Avenue between Winslow Way and Knechtel Way to place underground the
"service" utility wires on such property in accordance with Ch4pter 15.36 of the Bainbridge
Islaad Municipal Code; now, therefore
THE CITY COUNCIL OF 1'SE CITY OF: BAINBRIDGE ISLAND,
WASHINGTON, DO Y RESOLVE:
1. In conjunction with the City project to underground thI existing overhead "system"
utilities in Ericksen Avenue between Winslow Way an� Knechtel Way as part of a
street improvement project, the owner of each building or 'structure served by the utility
lines placed underground by the City project shall pla4 underground the "service"
utility wires from the connection point in the City ri t -of -way to the building or
structure, and remove from the property all overhead utility wires and related facilities
that served the building or structure.
2. The placement underground of the "service" utility w' es on such property and the
removal of the overhead wires and facilities shall be at tie property owner's cost and
expense in accordance with Chapter 15.36 of the Bainbrid e Island Municipal Code.
