RES 2003-12 UNDERGROUNDING OVERHEAD UTILITY WIRES ON WINSLOW WAYRESOLUTION NO. 2003-12
A RESOLUTION of the City of Bainbridge Island, Washington,
relating to the undergrounding of overhead utility service wires on
Winslow Way (Ericksen — SR305) by private property owners in
accordance with Chapter 15.36 of the Bainbridge Island Municipal
Code.
WHEREAS, the City Council passed Ordinance No. 2002-35 establishing Chapter 15.36
of the Bainb edge Island Municipal Code, providing a procedure to have owners of property
abutting projects where the system overhead utilities are placed underground in a street to place
underground the "service" utility wires on such property; and
WHEREAS, Property owners along the road were notified of the March 12, 2003 Public
Works & Transportation Committee meeting which discussed and recommended the Winslow
Way Under4ounding for Council action; and
WHEREAS, the City Council desires to require the owners of property abutting Winslow
Way (Ericks n — SR305) to place underground the "service" utility wires on such property in
accordance with Chapter 15.36 of the Bainbridge Island Municipal Code; now, therefore
CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO HEREBY RESOLVE:
1. In conjunction with the City project to underground the existing overhead "system" utilities
in Winslow Way (Ericksen — SR305) as part of a street improvement project, the owner of
each building or structure served by the utility lines placed underground by the City project
shall plae underground the "service" utility wires from the connection point in the City
right-of-way to the building or structure, and remove from the property all overhead utility
wires and related facilities that served the building or structure.
2. The placement underground of the "service" utility wires on such property and the removal of
the overhead wires and facilities shall be at the property owner's cost and expense in
accordance with Chapter 15.36 of the Bainbridge Island Municipal Code.
